Overview

This website is operated by Claudia Anne Designs, an independent UK business operated as a sole trader.

Throughout the website, the terms “we”, “us” and “our” refer to Claudia Anne Designs.

These Terms of Service set out the terms that apply when you access our website or purchase products from us. By using our website or placing an order, you agree to these Terms.

Nothing in these Terms affects your statutory rights as a consumer.

1. Our Products

We take care to ensure that product descriptions, photographs and other information displayed on our website are as accurate as possible.

Please be aware that colours may appear slightly differently depending on your device and screen settings.

Many Claudia Anne Designs products are handmade, personalised or made to order. As a result, there may be very small variations between individual items. These variations are part of the nature of personalised and individually produced products and are not considered faults.

2. Personalised Orders

It is the customer's responsibility to ensure that all personalisation information supplied when ordering is correct, including names, initials, spelling, wording, colours and other options selected.

Orders will be produced using the information submitted at checkout.

If you notice an error after placing your order, please contact us as soon as possible at hello@claudiaannedesigns.co.uk. If production has not yet started, we will do our best to make the requested change, but we cannot guarantee that changes or cancellations will be possible.

Products that are personalised or made to your individual specifications cannot normally be cancelled, returned or exchanged simply because you have changed your mind.

This does not affect your rights where an item is faulty, damaged, incorrectly made by us or not as described. Please see our Returns & Refund Policy for further information.

3. Orders

When you place an order through our website, you are offering to purchase the products in your basket.

You will receive an email acknowledging your order. We reserve the right to decline or cancel an order where reasonably necessary, for example where:

a product is unavailable;
there has been an obvious pricing or listing error;
we are unable to fulfil the requested personalisation;
payment has not been successfully authorised; or
we reasonably suspect fraudulent or unauthorised activity.

If we cancel an order after payment has been taken, we will refund the relevant amount to your original payment method.

4. Prices & Payment

All prices are displayed in pounds sterling (GBP) unless otherwise stated.

The price payable will be the price displayed at checkout when your order is placed, together with any applicable delivery charges.

We reserve the right to change our prices at any time, but changes will not affect orders that have already been accepted.

Payment must be successfully authorised before an order can be processed.

5. Shipping & Delivery

Our current processing times, delivery methods and estimated delivery times are set out in our Shipping Policy.

Delivery dates and times are estimates unless we have expressly agreed otherwise.

If your parcel is delayed, lost or damaged during delivery, please contact us at hello@claudiaannedesigns.co.uk so that we can investigate and assist you.

Nothing in these Terms limits any responsibility we have for delivery under applicable UK consumer law.

6. Returns, Cancellations & Refunds

Returns, cancellations and refunds are handled in accordance with our Returns & Refund Policy and your statutory rights.

Because many of our products are personalised or made to a customer's individual specifications, they may be exempt from the usual right to cancel an online order simply because you have changed your mind.

This does not affect your statutory rights if an item is faulty, damaged, incorrectly made or not as described.

7. Intellectual Property

Unless otherwise stated, all content on this website, including Claudia Anne Designs branding, original designs, photographs, graphics, written content, product descriptions and other creative material, is owned by or licensed to Claudia Anne Designs and is protected by applicable intellectual property laws.

You may use our website for personal, non-commercial purposes.

You must not copy, reproduce, republish, distribute, modify or commercially use our photographs, original designs, written content or other website materials without our prior written permission.

Purchasing a product from Claudia Anne Designs does not transfer ownership of any underlying design, artwork or intellectual property associated with that product.

Third-party trademarks, designs and intellectual property remain the property of their respective owners.

8. Website Use

You must not use our website:

for any unlawful or fraudulent purpose;
to interfere with the operation or security of the website;
to introduce viruses, malware or other harmful material;
to attempt to gain unauthorised access to the website or related systems; or
to infringe our intellectual property rights or the rights of another person.

We may restrict access to the website where reasonably necessary to protect our business, customers or website.

9. Accuracy of Information

We make reasonable efforts to ensure that information on our website is accurate and up to date.

Occasionally, information may contain errors relating to product descriptions, prices, availability, delivery information or other details.

Where we identify an error, we reserve the right to correct it. If an error affects an order you have already placed, we will contact you where appropriate.

10. Third-Party Services & Shopify

Our online store is hosted by Shopify, which provides the ecommerce platform that allows us to sell our products to you.

We may also use third-party services to provide functions such as payment processing, delivery and other website features.

Your use of certain third-party services may also be subject to the relevant provider's terms and privacy policies.

Any contract for products purchased directly from Claudia Anne Designs through this website is between you and Claudia Anne Designs.

Your personal information is handled in accordance with our Privacy Policy.

Please refer to our Privacy Policy for information about how we collect, use and protect your personal information and the third parties we use to operate our store.

12. Liability

We do not exclude or limit liability where it would be unlawful to do so.

Nothing in these Terms excludes or restricts your statutory rights as a consumer or our liability for matters that cannot legally be excluded or restricted.

We are not responsible for losses that were not reasonably foreseeable when you entered into the contract with us or for business losses arising from a purchase made by you as a consumer.

We may update these Terms from time to time to reflect changes to our business, website, services or applicable law.

The latest version will always be available on this page.

Any changes will not retrospectively alter the terms applying to an order that has already been placed, unless required by law.

14. Governing Law

These Terms are governed by the laws of England and Wales.

If you are a consumer living elsewhere in the United Kingdom, you will also retain any protections and rights available to you under the applicable laws of the part of the UK in which you live.
